A 51-year-old man working as a caregiver has been accused in the same court of raping a mentally retarded woman in violation of Section 3 of the Sexual Offenses Act 2006 at a flat in Umoja, Nairobi.
Daniel Waka is accused of committing the crime on an unspecified day in March this year on the roof of the building.
Another accusation against Mr. Waka is that on the same date, he performed an indecent act with the woman.
The physically disabled woman, 38, was allegedly approached and sexually assaulted while she was hanging clothes on the roof of the apartment building where she lives with her family.
He allegedly threatened to buy her chapatti and warned her not to tell anyone about what happened to her.
She was unable to recall the exact date of the accident due to her condition.
She was sent to Mama Lucy Kibaki’s hospital, where, after examining her, doctors determined she had been abused.
When the police concluded their investigations, Mr. Waka was subsequently taken into custody.
And before Kivuti, a judge of the Makadara Law Courts, he denied the charges.
The offender was released after posting a Sh100,000 bond.
The case will be mentioned on May 11 before the hearing begins on September 27 this year.
