A court in Nairobi heard testimony about how 91-year-old lawyer Akram Mohamed Khan obtained KES 63 million to buy land but never paid the owner.
Chief Justice Lucas Onena of Milimani was informed that the veteran lawyer had not performed his duty properly.
Onyina learned that Khan kept the money and the police could not find a single cent.
The court heard: “We left with the General Directorate of Defense for Children to pursue Khan to see if the money will be recovered or not, Khan was arrested but nothing has been recovered from him.”
In 2020, the witness and one other person are chosen by the executor of the deceased’s will to be trustees.
The lawyer is accused of stealing 63,700,000 shillings from property which the late Sukhdev Singh Mangat had entrusted to him while he was acting as his agent with others outside the court.
Between 4 December 2013 and 16 September 2014, he was charged with the offense at the Nairobi branch of Habib Bank Limited on Koinange Street.
In court, a power of attorney dated July 20, 2020 was shown to the judge.
According to information provided to the court, the trustee traveled to Kisumu to meet the relatives of the deceased and the lawyer of the late Mangat David Otieno.
“When we arrived in Kisumu, we wanted to know what legal issues were pending in the estate of the deceased. We were shown two pieces of land that had been sold,” he told the court.

Khan received a deposit of 10% of the total amount on March 15, 2014.
A sale agreement revealed that Khan received a payment of $6.3 million.
He followed up with a lawyer working on behalf of the buyer who paid a balance of KES 56 million to Khan at Habib Bank, which was then transferred to the Guardian Bank.
Khan has refuted the accusation and is now free from a million shillings bond.
The next session is scheduled for June 25, 2023.
